前些日子,一则“初中生反杀霸凌者获刑8年”的新闻引起了热议,该名初中生“反杀”的行为是否应构成正当防卫被广泛讨论。彼时《成长的法律烦恼》一书刚刚付梓,而此书十个法律故事之一讨论的恰是这个议题,连故事的细节都有几分相似。我不禁惊异于这意外的巧合,但或许,这恰恰得益于本书的主创之一——沈奕敏锐的观察和思考。
也许因为父亲(即本书的另一位作者沈宏山,现为国际大型律师务所的高级合伙人)律师的身份,沈奕从小耳濡目染,有着令人惊讶的法律敏感度,能从法律的视角审视生活中哪怕微小的事件。她常常与父亲共同探讨,深入而辩证地分析身边的故事所隐含的法律内核。由此,她观察到了青少年时常遇到却又常常被忽略的法律问题,觉察到了青少年法律意识的缺失,从而11岁就开始研究青少年法律案例。作为生活中的有心人,她希望能将令自己深深获益的法律知识分享出去,帮助更多的青少年朋友保护自己。于是,她把和父亲的讨论细致地记录下来,加上自己的研究心得,整理出了这本小书。
在这本书中,我们会跟随一个刚转入新学校的名叫艾莉的女孩,经历一系列看似普通却又暗含玄机的故事,倾听她和父亲深入浅出、苏格拉底启发式的法律探讨。艾莉充满爱心,健康活泼,喜欢画画,喜欢打排球,特别会思考爱提问——这虽然是虚构的人物,但显然有着沈奕的影子,书中的案例故事也都触手可及、似曾相识,这让那些艰深的法律知识不再严肃枯燥,变得亲切可爱、妙趣横生,也相信能解答不少读者朋友生活中的疑惑。

我们生活在一个群体社会中,出生伊始就与“自我”以外的其他人——最初就是父母——打交道,很少会像鲁滨孙那样被困于一个孤岛。在严复所称的“群己”关系中,我们持续不断地接受“应该怎样、不应该怎样”的教育,其中绝大多数事关如何待人接物。正是各种各样的权利义务关系,构成了一个虽然错综复杂但又基本井井有条的社会秩序。
然而,我们的生活并不总是平和安宁的,人与人之间的利益冲突和纠葛在所难免。从童年到少年再到青年,发生在自己身上和周边的冲突和纠葛会愈来愈多,或者被愈来愈多地意识到,疑问和困惑也就常常伴随左右。这也许就是一个从“不识愁滋味”到“识尽愁滋味”的过程。解决疑惑的视角、方法有多种,法律应该是其中最能细微区分差异情形中的权利义务配置的。
一个人可以不选择法律作为自己学习研究的主科,但一个人绝不可能不与法律产生交集,绝不可能永远不用法律思考或解决遭遇的问题,也绝不可能在完全欠缺法律意识和知识的情况下真正“长大成人”——用学术一点的语言就是真正“社会化”和“教化”。我们的成长,我们孩子的成长, 都需要法律的呵护,以及对这种呵护的足够认识。

我是沈奕,是一名高二的学生。
根据联合国的规定,18岁以下的人都是儿童和青少年,因此,我还是一名青少年。
现在全世界共有青少年和儿童约18亿人,占全世界人口的24%左右。可是你知道吗,每年、每天都有很多青少年和儿童遭受身体上或精神上的伤害。根据联合国的统计:
全球5岁以下的儿童中有近20%因营养不良导致发育迟缓;
全球13岁至15岁的学生中,有约1.5亿人受到过欺凌,约占相关人口总数的50%左右;
另外,全球每7分钟就有一名青少年因为暴力而丧生。
你被别人欺负或者伤害过吗?你有没有心爱的玩具或者其他什么宝贝的东西被别人抢走过呢?如果真是遇到了这些困难,又会寻求谁的帮助?
对,你可以告诉自己的父母或者家人,也可以找老师帮忙,还可以告诉自己的朋友。还有呢?很好!你还可以找警察来帮助你。
但是,最终还是要靠我们青少年自己在精神上、身体上和知识上强大起来,其中就包括学习和了解一些法律常识。
我从小就喜欢研究法律故事,经常和作为律师的爸爸一起讨论学校里发生的或者媒体上报道的青少年法律事件。这些故事和讨论滋养着我一路成长,更悄悄地开启了我研究青少年法律问题的大门。随着研究的积累和深入,我发现,学习一些法律常识很有好处,它不仅仅能教会我们如何尊重别人,不伤害别人,同时也会让我们知道如何更好地保护自己。
三年前我开始着手撰写《成长的法律烦恼》一书,想借此让更多的青少年朋友我的研究和感悟,也希望能帮助到更多的人。
写作过程中一切的烦躁、不安和日积月累的重复至今还历历在目!尤其是今年3月本书修订最忙碌之际,新冠肺炎疫情在全球大爆发。每天从媒体上听到或看到很多患者不幸离世的消息,让人心痛不已!但是,我们更听到或看到了很多在灾难面前人们勇敢地互相帮助、团结友爱的感人故事,鼓励我们在黑暗中坚持和坚守!
2020年11月,历经三年多时间,由我和父亲合作的中英文对照的《成长的法律烦恼》一书由复旦大学出版社正式出版。国内外知名的复旦大学出版社能够出版本书,既是对青少年健康和成长问题的莫大关注,更是对我极大的鼓励!谢谢编辑李荃女士,谢谢北大法学院沈岿教授欣然接受为本书代序,感谢Katherine Fidler博士和Yao/studio puke ink,你们的爱在这至暗时刻显得更加璀璨和温暖!

calling attention to adolescents’ own legal cases!
Hi, everyone!
I am Emily Shen, and I am a junior in high school.
According to the United Nations, anyone under the age of 18 are classified as children and adolescents. Therefore, I am still a teenager.
There are about 1.8 billion teens and children in the world, accounting for about 24% of the world’s population. Do you know that every dayand every year, many teenagers and children suffer from physical or mental injuries and difficulties? According to the United Nations’ statistics:
Nearly 20% of the children under the age of 5 are stunted due to malnutrition.
About 150 million students between the ages of 13 and 15 have been bullied, accounting for about 50% of the population in this age group.
In addition, around the world, for every 7 minutes, a teenager is murdered due to violence.
Have you been bullied or harmed by others? Have your other precious possessions been snatched by others? If you encounter these difficulties, who would you turn to for help?
Yes, you can tell your parents or family members or ask a teacher for help, and you can also tell your friends, right? Well, if necessary, you can also seek help fromthe police.
However, in the end, we must rely on ourselves to become stronger mentally, physically and intellectually, which includes learning and understanding some sort of legal knowledge.
Since I was a child, I have been passionate about researching and learning about legal stories. Oftentimes, I would discuss juvenile legal incidents that I had encountered in school or those that had been reported in the media with my lawyer father. These stories and discussions have nourished my growth along the way, and quietly opened the door for me to study juvenile legal issues. With the accumulation and deepening of my research, I realized that having a general understanding of common legal knowledge is very beneficial. Not only does it teach us how to respect and not harm others, but it also lets us know how to better protect ourselves.
Three years ago, I started to write the bookGrowing Pains in Law.I want to share my research and insights with other teenagers of my age with the hope of helping more people.
All the frustration, restlessness and repetitions in the writing process are still fresh and vivid in my head! For example, when the book revision process was at its busiest in March of this year, the novel coronavirus pandemic broke out globally. It is heartbreaking to hear or read about the unfortunate passing of many patients on the media every day! However, I have also heard and seen many touching stories of people bravely helping each other, uniting and loving each other in the face of a disaster. These moments are encouraging us to persevere and look forward to the light at the end of the tunnel!
In November of 2020, after more than three years, the book Growing Pains in Law, a Chinese and English bilingual collaboration between my father and I, was officially published by Fudan University Press. As a well-known publisher in China and abroad, Fudan University Press’ publication of this book not only demonstrates great concern for the health and growth of adolescents, but also acted as a great encouragement to me! Thank you to editor Ms. Li Quan, thank you to Professor Shen Kui of Peking University Law School for writing the preface to this book, and another special thank you to Dr. Katherine Fidler and Yao/studio puke ink. Your love and support are even warmer and more radiant in this darkest moment!
Next, I will be discussing some legal issues related to the daily life of teenagers with you. Each episode has a story and a theme. Not all of these case stories happened to me personally or to my friends, but they are all possible stories that exist in our daily lives. My analysis is not necessarily the only correct answer, but I hope it can inspire you. Of course, if any of these legal stories can help you or your friends out, then I would be beyond grateful for their impact!
